KYLANS AVATAR TERMS OF SERVICE

BY COMMISSIONING ME YOU ARE AGREEING TO MY TERMS OF SERVICE. IF YOU HAVE ANY ISSUES OR QUESTIONS REGARDING THESE PLEASE DON'T HESITATE TO CONTACT ME ON DISCORD. ( kylanjuhl )First things first I have the right to refuse a commission for any reason!When commissioning me both you as the commissioner and me as the artist need to own every models and/or assets used. If I do not own the model and/or any assets you are interested in, those will be added to the commission price. YOU WILL STILL NEED TO BUY THEM FOR YOURSELF!I DO NOT DO QUEST STANDALONE AVATARS! i do my best to make all my avatars quest compatible if possible however I cannot guarantee it. By commissioning me you are saying that you are connected to a PC. If I find out you are on quest your commission will stop and you will be sent any work I had completed up to that point and you will NOT receive a refund..
Custom Assets

If you commission a custom asset from me without it being attached to a model you will receive a unity package with just the clothing assets in it NOTE: I do not work with VRCFury so you'll have to manually add it yourself. I do not guarantee optimization for quest usage on any of my assets however i will include materials for use on the quest side in the package.

Commercial Use - The assets I make are not for commercial use, they are made specifically for the person who commissioned them from me and the receiver of the assets are not to give them out to others or claim credit. If you need them for an avatar you wish to sell let me know and we can discuss the terms of use but for the commercial use if an asset i make specifically for you is use I must be given full access to the finished avatar upon request. And the asset must be fully attached to the model (not just added in unity) If you fail to comply with the commercial use TOS your access to the asset will be revoked and I will gain the right to put it for sale. You will also be blacklisted from my work as well as those of some avatar makers I work with.

Creative Freedom
.
If you commission me for something that is creative freedom, weather that be textures, assets, etc. That means you are giving me full creative control, I will not go back and fourth on designs, if you wanted to be specific you need a ref sheet and not creative freedom. I will stick to any inspiration images provided but as stated will not be going back and changing things, if you wanted specific stuff i need reference sheets.

PAYMENTS & REFUNDS
.
On all of my commissions, I ask for payment prior to starting on the project, payment plans are an option and can be discussed before the commission slot is confirmed. I will NOT begin working on the project until I have received full payment. Please do not send me any payments before there is an agreement on both sides of the commission.

All payments must be made through PayPal, you will be sent an invoice and I will confirm with you when I have received the payment(s).

If there is a problem at any point and I am unable to do your commission you will be refunded in full. However, if I have already started working on your commission and you decide you no longer want it, you will either get a partial refund or no refund depending on how long I have already spent working on it.

If you request any major changes that weren't discussed prior to starting the commission then you will be charged fees, especially if it's after the commission has been fully finalized between us.

If you have any questions on price you may request an itemized checklist to see what all goes into the cost of your commission.

TURNAROUND TIME & WORKING HOURS
.
I am unable to always make commissions the priority in my life. Because of this, I will give an estimated start time when you are added to my Trello queue, you can view this at all times. If there is a deadline for the project please let me know from the start! Rush orders are also an option but will result in an extra fee.

I always work on my commissions in order of who paid first as it is just fair that way. Of course, larger commissions will take a lot more time to complete so please be patient with me. If you are worried about your commission you can always check my queue on my Trello or contact me directly.

UPLOADING YOUR COMMISSION
.
When I have finished your commission I hold the right to upload the commission to my Twitter, TikTok and other forms social media of my choice. I will send you the finished commission as a unity package with everything youll need in it as a gumroad link and you will be able to download it through your gumroad. I am also able to upload your finished VrChat retextures to your VrChat account for you if necessary however there is a small upload fee.

Fixing any issues after finished
.
After the commission is completed you have a 30 day period to report any issues with the avatar you've found that needs to be fixed. And if a reasonable issue I will go back and fix it. Note: this applies only to things that are wrong, this not apply just because you want something changed. For example, I will fix major clipping issues with clothing iv added, toggles not working properly, weight painting being off with stuff I added. However I will NOT change things such as you decided you didn't like the outfit you asked me to put on, you changed your mind and wanted to remove some markings, or if the base avatar has a feature that's broken that was not my fault. I am willing to change some things on the wont change list however there will be a charge as most of the stuff is stuff you decided you didn't like or stuff that I didn't make a mistake with in the first place.

NSFW WORK
.
If NSFW add on or you are commissioning me for a texture on a NSFW avatar I will require proof of age in the form of a valid ID if you cannot provide this I will have to refuse your commission. I will NOT
add NSFW parts or features to child or chibby avatars. And if I find out that you take the avatar I made and put NSFW characteristics on it after the fact you will be blacklisted from my commissions (only applies to child or chibby avatars). If an avatar model comes with NSFW features by default I will remove the menus for it. If youd like it to be left on There will be a $25 fee and I will need proof of ID.

I DO NOT give out substance painter files so please do not ask as I am not comfortable doing so.

Adding Accessories, clothing, or other assets to the avatar
The price is that of the item +$10 and I will create a toggle for it as well. Items will use texture that comes with them unless specified you want them changed. (this excludes body changes tail, wings, horns, etc.)

Kitbashes
Any form of kitbash will half the price of both models added together this may change depending on complexity

Custom Assets
Any custom asset is automatic $25 charge and will go up depending on complexity and i need exact refrence sheets for what your wanting.
